This Acceptable Use Policy (“AUP”) applies to your access and use of the OceanBase Cloud Services.
Capitalised terms used but not defined herein shall have the respective meanings set forth in the applicable agreements between you and OceanBase, including but not limited to the OceanBase Cloud Services Agreement, the Service Level Agreement for OceanBase Cloud Services, the OceanBase Data Processing Addendum, the Privacy Policy, and any applicable Order Form (collectively, the “Applicable Agreements”).Notwithstanding anything to the contrary in the Applicable Agreements, in the event of any conflict or inconsistency between the Applicable Agreements and this AUP, this AUP shall govern. Any violation of this AUP may result in the suspension or termination of your access to and use of the OceanBase Cloud Services.
We may modify this AUP from time to time upon reasonable notice to you (which may be provided through the OceanBase Cloud Services or by posting an updated version of this AUP on our website(s)). By using the OceanBase Cloud Services, you agree to the latest version of this AUP.
You agree to, and shall procure that your Affiliates and Representatives:
1. comply with all applicable Laws when accessing and using the OceanBase Cloud Services; and
2. take all reasonable steps to protect the OceanBase Cloud Services against accidental or unauthorised access or use, disclosure, modification, destruction, loss or misappropriation.
You agree not to, and shall procure that your Affiliates and Representatives not, and not allow third parties to, use the OceanBase Cloud Services:
1. to store, process, transmit, or make available content or technology (a) that is infringing, libellous, unlawful, tortious, defamatory, harassing, obscene, illegal, violating privacy rights, or in violation of any third-party rights, (b) that threatens, incites, promotes or actively encourages, advocates or advances violence, terrorism, or other serious harm, and any content or activity that promotes child sexual exploitation or abuse, criminal hacking, cracking, or phishing, or (c) that is malicious contents, unlawful software or malicious code, such as malware, viruses, worms, time bombs, and other harmful or malicious files, scripts, agents, or programs;
2. for illegal, threatening, or offensive uses, or for similarly objectionable purposes, e.g., propagating hate-related or violent material, and/or material advocating discrimination against individuals or groups, or causing harm to others or to our reputation;
3. to engage in any activities, or upload onto the platform any information or data, in each case related to or in connection with cryptocurrency or crypto-mining;
4. to use the OceanBase Cloud Services to cause damage or injury to any person or property;
5. to copy, reverse engineer, decompile, or disassemble any element of, use data gathering or extraction tools, or otherwise discover any source code, object code, software programs, processes, algorithms, methods, techniques, data, or information embodied in the OceanBase Cloud Services, or any part, feature, function or user interface thereof, or to harm, interfere with, or limit the normal operation of the OceanBase Cloud Services, including monitoring traffic or data;
6. to transact in, or facilitate activities related to, misappropriating another individual’s identity, including without limitation, improperly obtained credit card information and/or account credentials;
7. to attempt to gain unauthorised access to the OceanBase Cloud Services or any related systems, including those of OceanBase’s subcontractors and other customers or users;
8. to build similar or competitive products or services;
9. to interfere with or damage the proper functioning of other users’ use or access of the OceanBase Cloud Services;
10. to tamper with, hack, or otherwise disrupt any computer system, server, or networked device associated with the OceanBase Cloud Services; and
11. to permit direct or indirect access to or use of the OceanBase Cloud Services (a) in a way that violates the Applicable Agreements, or (b) to access to or use any IP Rights in or related to the OceanBase Cloud Services except as permitted under the Applicable Agreements.
